Welcome to the Baby Central website terms and conditions for use. It is important that you carefully read these terms and conditions of use before you register with baby-central.co.uk because your use of our website is subject to them.
We apologise for this section being so long and containing lots of technical and legal stuff, however we need to make sure that you, Baby Central and our website are all protected. As a retail business Baby Central has worked hard to gain a reputation for excellent customer service and our aim with this website is to provide that excellent service online. The legal bits are also important because we allow people to store and send photographs using our site and we need to ensure that both ourselves and our customers are protected against any misuse of that part of the site.

We provide services to you through our website and those services are provided to you on the basis of these terms and conditions. Please note that they may vary from time to time without notice to you. These terms and conditions apply to the use of this website at www.baby-central.co.uk.
Using this website indicates that you accept these terms regardless of whether or not you choose to order from us. These terms and conditions govern your access to and use of the website. If you do not accept, or wish to be bound by these terms, please do not use this website. 1. INTRODUCTION

1.1 This website is operated by Baby Central Limited, a company registered in Scotland, whose registered office is at Macfarlane Gray House, Castlecraig Business Park, Springbank Road, Stirling, FK7 7WT, company registration number 296000 and VAT registration number 895 4683 60.

1.2 Most areas of the Website can be accessed without registration. Certain areas of this Website however, are only accessible if you register.

1.3 These terms and conditions are binding and may be updated. You should check this Website regularly to review the most current terms and conditions.

2. PRODUCTS

2.1 We make every effort to ensure all items on our website are accurately portrayed. On occasion there may be slight variances in colour, size or shape of products due either to modifications by the manufacturers or simply because of variances in the calibration of customer computer equipment. Baby Central will not attempt to mislead customers or sell any items other than the bona fide original products described.

2.2 All products offered are compliant with British and where necessary European Standards. In the event of a product recall, all necessary measures will be taken in conjunction with the manufacturer to notify you of such an event.

3. PRICING

3.1 All prices include VAT (where applicable) at the current rates.

3.2 Where Baby Central charge separately for packaging, postage and other relevant charges, the appropriate rates are set out in the pricing structure shown on the Website.

3.3 Baby Central reserve the right to change their prices either up or down. This will not affect any confirmed order value. The displayed price for a product may at some point change after your purchase, for reasons of increased supply costs, promotional offers, etc

4. ORDERING

There are 2 ways to order using www.baby-central.co.uk: Online or by telephone

Online

4.1 You are deemed to have placed an order once having completed the online checkout process. As part of the checkout process you will be given the opportunity to check your order and to correct any errors, an order acknowledgement will then be sent to you, detailing the products you have ordered.

4.2 Acceptance of an order occurs once the order has been dispatched and a dispatch confirmation has been sent by email. The purchase contract is made once the order has been dispatched.

4.3 The contract is not finalised if you receive notification that the order has not been accepted or if the order has been cancelled.

4.4 An order may be refused where:

4.4.1 Goods are unavailable;

4.4.2 Authorisation cannot be obtained for your payment;

4.4.3 There has been a pricing or product description error; or

4.4.4 Any of the eligibility criteria as set out in the terms and conditions has not been met.

4.5 Unfortunately we cannot accept orders from outside mainland UK, at this time

4.6 Many customers, particularly when purchasing baby products would prefer to talk to an experienced customer advisor before buying. Please call us at the showroom on 01786 448202 if you wish to purchase anything you see on our website. We can try to answer any questions you may have or we may be able to advise you of the product’s suitability or suggest alternatives.

5. PAYMENT

5.1 We accept payments by the following means: Visa, Visa Electron, Switch, Delta, MasterCard and Solo.

5.2 In the case of telephone orders we are also able to accept payment by cheque. Please confirm this when your order is being confirmed. You must allow a longer period for processing an order on this basis, whilst the cheque is being received and processed – typically this may take an additional 5 working days. Cheques must be made payable to ‘Baby Central Limited’.

6. PRODUCT AVAILABILITY AND DELIVERY/SHIPPING

6.1 All products displayed on www.baby-central.co.uk are subject to availability.

6.2 We hold most of our items in stock for immediate delivery, and we will endeavour to dispatch all confirmed orders to arrive at the delivery addresses within 3 working days. However some of our larger items are ordered directly from manufacturers and are dispatched directly to our customers. Delivery for these items may be longer. For example the usual delivery time for Boori furniture is 3-5 weeks for standard items. The expected delivery times will be stated in the description of these items where appropriate.

6.3 Goods currently held in stock will be normally be dispatched within 24 hours of order and delivered between 9.00am and 3.00pm the following working day (Monday to Friday). Customers may specify if they wish a delivery prior to 9.30am Monday to Friday or delivery on a Saturday, however there is a £10.00 surcharge for this service.

6.4 If for any reason there is a change to the stated delivery time for any product we will notify you as soon as possible to check that any new delivery timescale is still acceptable to you.

6.5 All purchases of the value of £50.00 (UK) sterling and above, will be despatched free of charge. Purchases under £50.00 will be subject to a typical £5.99 delivery charge. Delivery of furniture is usually free, though this is dependent on the manufacturer; whom in many instances will deliver direct to the customer. Should a delivery charge be applicable this will be detailed and agreed before processing your order.

6.6 Delivery prices quoted are for UK mainland delivery only.

7. CANCELLATION AND RETURNS POLICY

7.1 In addition to your statutory rights, a refund or exchange is offered on any items returned unused and in a saleable condition within 7 days of receipt.

7.2 Distance Selling Act – Does not include items purchased from our premises

Full policy details are as follows:

7.3 If you wish to cancel your order:-

7.3.1 Where goods have yet to be dispatched, then by email to baby-central.co.uk.

7.3.2 Where goods have been dispatched, by returning said goods in accordance with clause 7.4 below.

7.4 Provided that the items returned within 7 days have not been used and are in a saleable condition with their original packaging, a full refund of the amount paid, or an exchange credit will be given.

7.5 The goods are to be returned at your own expense. If you require us to arrange collection of an item, please contact us for a quote. If you intend to arrange return of unwanted goods yourself we recommend that you use a form of postage / courier that provides a proof of sending, as we cannot be held responsible for items that fail to reach us.

7.6 The refund excludes the cost of post/carriage of goods to yourself. The refund will be issued within 30 days of Baby Central receiving the goods in their original condition.

7.7 The following goods are exempt from our returns policy:

Mattresses – for reasons of hygiene we do not sell mattresses where the protective outer covering has been removed.

Car Seats – Unless sold directly from our premises we are unable to confirm if the product has been involved in a collision under which circumstances the seat should not be re-used.

7.8 Self-assembly furniture cannot be refunded if assembly is part or fully completed unless the item is faulty. When returning items please tape an envelope to the outside of the packaging, containing your name, address and order number or receipt number.

8. RETURN OF GOODS – DAMAGED OR DELIVERED IN ERROR

8.1 If the goods fail to correspond with their description, are not of satisfactory quality, or reasonably fit for their purpose and Baby Central Limited is notified in a reasonable time of the problems customers are entitled to a full refund [with consideration for relevant associated losses];

8.2 Goods that are damaged or faulty on delivery to the Purchaser or have been delivered in error can be returned to Baby Central Limited the procedures outlined in clause 7 above. When returning Goods that are damaged or faulty on delivery to the Purchaser or have been delivered in error, the Purchaser will not be responsible for the costs of returning the goods to Baby Central Limited.

8.3 The decision as to whether the product is faulty or has been subject to misuse will be determined by the manufacturer if not immediately apparent.

8.4 At the Purchaser's option Baby Central Limited will either give a full refund or where possible make good or replace any Goods which are damaged or defective on delivery to the Purchaser

9. LICENCE

9.1 You are permitted to print and download extracts from this Website for your own use on the following conditions:-

9.1.1 No documents or related graphics on this Website are modified in any way.

9.1.2 No graphics on this Website are used separately from the accompanying text.

9.1.3 Copyright, trade mark notices and these terms and conditions appear in all extract copies from the website.

9.2 Unless otherwise stated, the copyright and other intellectual property rights in all material on this Website (including without limitation photographs and graphical images) are owned by Baby Central Limited or licensed to Baby Central Limited. For the purposes of these terms and conditions, any use of extracts from this Website other than in accordance with clause 9.1 above for any purpose is prohibited. If you breach any of the terms in these terms and conditions, your authority to use this Website automatically terminates and you must immediately destroy any downloaded or printed extracts from this Website.

9.3 Subject to clause 9.1, no part of this Website may be reproduced or stored in any other website or included in any public or private electronic retrieval system or service without prior written permission.

9.4 Any rights not expressly granted in these terms are reserved.

10. SERVICE ACCESS

10.1 While Baby Central endeavours to ensure that this Website is available 24 hours a day, Baby Central will not be liable if for any reason this Website is unavailable at any time or for any period.

10.2 Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair, or for reasons beyond our control.

11. LINKS TO AND FROM OTHER WEBSITES

11.1 If links to third party websites are used then you automatically leave this Website. We are not responsible for third party websites, their content or availability. We therefore do not endorse or make any representations about them, any material found there, or any results that may be obtained from using them. 14. Digital Image Storage - You control who sees your photos.

14.1 Baby-Central.co.uk allows registered users to upload up to 10 images per user onto our secure server. Digital Images are stored and viewable in screen resolution on the Site. It is designed to provide a private, secure place for you to store and share your photos. Only you and the friends and family members that you choose to invite have access to your photos.

Your personal information is protected. Your privacy is important to us and we take great care to protect it. Please see our Privacy Policy for details.

15. Member Conduct

15.1 We are committed to ensuring that our Service remains a safe place to print, store and share digital photographs. Members can use the Service to post creative material, including (without limitation) photographs, digital images, and comments (the "Content"). To this end, we require that every user of the Service, whether or not such user is a Member, agrees not to use this Service to print, post, upload, store, share or otherwise obtain Prohibited Content. Generally, Prohibited Content includes (without limitation) any of the following types of Content:

15.1.1. Content we believe is abusive, deceptive, pornographic, obscene, defamatory, slanderous, offensive, or otherwise inappropriate.

15.1.2 Copyrighted material that is used without the express permission of the owner

15.1.3 Content that violates or encroaches on the rights of others.

15.1.4. Content or other material that contains viruses, worms, corrupt files, Trojan horses and other forms of corruptive code or any other content, which may compromise the Service.

16.1 In order for us to make your photos available to you and your invitees we need the rights to make use of all Content on the Service (in accordance with and subject to these Terms, of course).

16.2 Accordingly, as a condition to your Membership, you hereby grant Baby Central a perpetual, universal, nonexclusive right to copy, display, modify, transmit, make derivative works of and distribute any Content transmitted or provided to the Service by you, solely for the purpose of providing the Service.

16.3 You remain the owner of all Content that you submit to the Service and as a condition to Membership, you represent and warrant to Baby Central that you are the owner of any copyright to Content you submit to the Service or that you have written permission from the copyright owner to submit such Content.

17. GOVERNING LAW AND JURISDICTION

17.1 These terms and conditions shall be governed by and construed in accordance with Scottish Law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Scottish courts.

17.2 We do not warrant that materials/items for sale on the Website are appropriate or available for use outside the United Kingdom. If you access this Website from locations outside the United Kingdom, you do so at your own risk and you are responsible for compliance with local laws.
